Why Transportation Businesses Need Special Licensing
Unlike most businesses, transportation companies that operate across state lines or carry commercial freight are regulated by the federal government through the Federal Motor Carrier Safety Administration (FMCSA). Operating without proper authority is illegal and can result in heavy fines, vehicle impoundment, and loss of your business.
Step 1: Form Your Business Entity First
Before you register with the DOT, you need a legal business entity — an LLC or Corporation. This is your foundation. You'll also need an EIN from the IRS. If you haven't done this yet, our Business Formation team can have your LLC ready in as little as 48 hours.
Step 2: Register for a USDOT Number
A USDOT (United States Department of Transportation) number is a unique identifier assigned to your company for safety monitoring and compliance tracking. You register for it through the FMCSA's online portal (FMCSA.dot.gov). It's free to obtain, but the registration process requires detailed information about your business, your vehicles, and your intended operations.
Step 3: Apply for Motor Carrier (MC) Authority
If you plan to transport goods for hire across state lines, you need MC Authority in addition to your USDOT number. This is your operating authority — without it, you cannot legally haul freight commercially. The application fee is $300 and approval typically takes 20–25 business days.
Step 4: File Your BOC-3 (Process Agent Designation)
The BOC-3 is a federal requirement that designates a process agent in every state where you operate. This agent accepts legal documents on your behalf. You must have a BOC-3 on file with the FMCSA before your MC Authority becomes active. We file this for all our transportation clients.
Step 5: Enroll in a Drug & Alcohol Testing Consortium
Federal law requires all commercial drivers to be enrolled in a DOT-compliant drug and alcohol testing program. As the business owner, you must have a testing policy, a designated employer representative, and a consortium or third-party administrator managing your testing records. Step 6: Get the Right Insurance
The FMCSA requires minimum insurance levels depending on what you haul. For general freight, the minimum is $750,000 in liability coverage. For hazardous materials, it goes up to $5 million. Your insurance provider must file proof of coverage directly with the FMCSA using Form MCS-90.
Step 7: Get Your UCR Registration
The Unified Carrier Registration (UCR) is an annual fee paid by interstate carriers based on fleet size. It's required in addition to your MC Authority and must be renewed every year.
Step 8: Set Up Your Driver Compliance System
Whether you have 2 drivers or 200, you need systems for driver qualification files, hours of service logs, vehicle inspection reports, and accident records. This is where many small transportation companies get into trouble — and where we save our clients from costly violations.
